Terms of Service

These Terms of Service govern your use of NorthMap Digital Insights. They explain what the site provides, what is permitted, and how issues are handled. If you do not agree with these terms, please do not use the site.

1. Acceptance and eligibility

By accessing or using this website (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and that organization.

You must be at least 16 years old to use the Site. If you are between 16 and the age of majority in your place of residence, you may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms. The Site is intended for a general audience and provides informational content about digital trends and online platforms in Canada.

2. Service description

NorthMap Digital Insights publishes neutral, educational articles and checklists about online platforms and digital tools. The Site may include explainer content, guides, a newsletter subscription form, and links to related pages. The purpose is to support reader understanding of common platform mechanics such as accounts, cookies, recommendations, and privacy settings.

The Site does not provide individualized legal, financial, or professional advice. Any examples are illustrative and may not reflect the features, policies, or availability of any particular third-party service at the time you read them. You are responsible for confirming details directly with the relevant service provider before making decisions based on information from the Site.

We may update, change, suspend, or discontinue any part of the Site at any time. We may also place reasonable limits on use to protect the security and performance of the Site.

3. User obligations

You agree to use the Site lawfully and in a way that does not interfere with others’ access or the Site’s operation. When interacting with any forms on the Site, you agree to provide accurate information and not to submit content that is misleading or unlawful. If the Site offers optional subscription features, you agree to subscribe only with an email address you control.

You also agree that you will not attempt to bypass access restrictions, security controls, rate limits, or consent mechanisms. If you encounter a vulnerability or security issue, you agree to report it responsibly using the contact information in these Terms, rather than exploiting it.

4. Intellectual property

The Site and its content, including text, layout, graphics, branding, logos, and underlying code, are owned by NorthMap Digital Insights Ltd. or licensed to it and are protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or exploit the Site or content without prior written permission.

Subject to your compliance with these Terms, NorthMap grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial informational purposes. This license does not permit you to use the Site’s brand assets, to scrape content at scale, or to republish full articles on other websites.

5. Prohibited activities

To protect readers and the integrity of the Site, you agree not to engage in any of the following activities:

  • Attempting to gain unauthorized access to the Site, servers, or related systems, including through hacking, password mining, or vulnerability exploitation.
  • Scraping, crawling, or harvesting content or data using automated means in a way that burdens the Site, bypasses controls, or violates robots instructions.
  • Submitting spam, unsolicited messages, deceptive form entries, or content designed to manipulate analytics or measurement.
  • Impersonating any person or organization, or misrepresenting your affiliation with NorthMap Digital Insights.
  • Uploading, transmitting, or distributing malicious code, malware, or content intended to disrupt the Site or compromise users.
  • Violating any applicable laws or third-party rights, including copyright, privacy, or publicity rights.
  • Reverse engineering or attempting to derive source code from the Site except to the extent permitted by mandatory law.

We may investigate suspected violations and may suspend or restrict access when we believe a violation has occurred or when needed to protect the Site and users.

6. Disclaimer of warranties

The Site and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, NorthMap Digital Insights Ltd. disclaims all warranties and representations of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We also do not warrant the accuracy, completeness, timeliness, or usefulness of any content. Readers should verify information independently, especially where platform policies or features may change.

7. Limitation of liability

To the fullest extent permitted by applicable law, NorthMap Digital Insights Ltd. and its directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or relating to your use of, or inability to use, the Site.

To the fullest extent permitted by applicable law, NorthMap Digital Insights Ltd.’s total liability for any claim arising out of or relating to these Terms or the Site is limited to the lower of: (a) the amount you paid to NorthMap Digital Insights Ltd. in the 12 months immediately preceding the event giving rise to the claim, or (b) EUR 100. If no fees were paid, the cap still applies.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. In such cases, liability will be limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless NorthMap Digital Insights Ltd. and its directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your access to or use of the Site; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

9. Third-party links

The Site may reference or link to third-party websites or services for background information. Third-party services are not under our control, and we are not responsible for their content, policies, availability, or practices. Your use of third-party websites is at your own risk and subject to their own terms and privacy policies.

A link does not imply endorsement. When evaluating external services, consider reviewing their privacy disclosures, security options, and support channels directly.

10. Privacy

Our Privacy describes how we collect, use, share, and retain information, including how cookies and similar technologies are used and how you can exercise data rights. The Privacy page is incorporated into these Terms by reference.

If you use any subscription feature, you understand that we will process your email address for the purpose of providing the requested updates, and you may opt out at any time as described on the Privacy page.

11. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to these Terms or the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules.

Subject to Section 12 (Dispute resolution), you agree that the courts located in Toronto, Ontario will have exclusive jurisdiction over any legal action or proceeding arising under or relating to these Terms or the Site, and you consent to personal jurisdiction in those courts.

12. Dispute resolution

If you have a concern or dispute related to the Site, you agree to contact us first and attempt to resolve the issue informally. Provide a clear description of the issue and any relevant details so we can investigate. We will make a good-faith effort to respond and resolve the matter within a reasonable time.

If the dispute is not resolved within 30 days of your first written notice, either party may pursue formal proceedings in accordance with Section 11 (Governing law and jurisdiction). Nothing in these Terms limits any rights you may have that cannot be waived under applicable law.

13. Termination

We may suspend or terminate your access to the Site, with or without notice, if we reasonably believe you have violated these Terms, created risk for other users, or interfered with the operation or security of the Site. We may also take steps to limit access to protect the Site from abuse or excessive automated traffic.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.

14. Modifications to these Terms

We may update these Terms from time to time to reflect changes to the Site, legal requirements, or operational practices. Updated Terms will be posted on this page with a revised “Last Updated” date. Unless a change is required to take effect sooner for legal reasons, changes will become effective 14 days after posting.

By continuing to use the Site after the effective date of any updated Terms, you agree to the revised Terms. If you do not agree to an update, you should stop using the Site.
